Kiwell Terms of Service

Welcome to Kiwell. By downloading or using the Kiwell mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and the Kiwell Development Team (“Kiwell,” “we,” “us,” or “our”).

1. Medical Disclaimer (Important)

Kiwell is a self-care and emotional well-being support tool and is not a medical device. All content provided through the App, including AI Chat, Tarot readings, and “The Book of Answers,” is intended for informational, entertainment, and self-reflection purposes only.

Kiwell does not provide medical advice, diagnosis, or treatment, and we are not licensed healthcare professionals or therapists. If you are experiencing a mental health crisis, emotional distress, or have a medical concern, please seek assistance from a qualified healthcare professional or contact local emergency services immediately.

2. AI and Reflective Features

AI Chat

AI Chat is designed to offer supportive and reflective responses. However, AI-generated content may be inaccurate or incomplete. You agree not to rely on AI Chat for professional advice, including but not limited to medical, legal, financial, or mental health treatment decisions.

Tarot & Book of Answers

Tarot readings and “The Book of Answers” are generated using randomized or algorithmic processes and are provided solely for entertainment and personal reflection. They are not intended to predict future events or outcomes.

You acknowledge that any interpretation or use of information provided by these features is at your own discretion, and you remain responsible for your decisions.

3. User Conduct

You agree to use Kiwell respectfully and lawfully. You must not:

• Use the App for any unlawful purpose under applicable local or international laws;
• Attempt to exploit, manipulate, or interfere with the App, including attempting to bypass safeguards or generate harmful, hateful, explicit, or illegal content;
• Reverse-engineer, decompile, or disassemble any part of the App, except as permitted by law.

4. User-Generated Content

You retain ownership of content you submit through the App, such as journal entries or AI inputs (“User Content”).

By submitting User Content, you grant Kiwell a non-exclusive, worldwide, royalty-free license to store, display, and process such content solely for the purpose of providing and improving the App’s services.

You represent that your User Content does not infringe upon the rights of any third party, including intellectual property or privacy rights.

You may report inappropriate content through Settings → Help & Feedback → Report Violations. Reports will be reviewed within a reasonable timeframe.

5. Subscriptions and Payments

Certain features of Kiwell require a paid subscription (“Kiwell Plus”).

• Payment Processing: All payments are processed through the Apple App Store or Google Play Store. Kiwell does not collect or store payment card information.
• Auto-Renewal: Subscriptions renew automatically unless canceled prior to the renewal date, in accordance with the policies of the applicable app store.
• Cancellation: You may manage or cancel your subscription through your device’s App Store or Play Store account settings.

6. Limitation of Liability

To the fullest extent permitted by applicable law:

• Kiwell shall not be liable for indirect, incidental, consequential, or special damages arising out of or related to your use of the App.
• Nothing in these Terms limits liability for intentional misconduct, gross negligence, or personal injury where such limitation is not permitted by law.
• The App is provided on an “as is” and “as available” basis, without warranties except where required by law.

7. Service Changes, Suspension, and Termination

We may update, modify, or discontinue features of the App from time to time. Where reasonably possible, we will provide advance notice of material changes.

We may suspend or terminate access to the App if you materially violate these Terms. Upon termination, you may request export of your personal data through the App where supported.

8. Account Deletion

You may delete your account at any time via Settings → Account → Delete Account.

Upon deletion:

• Personal data will be removed from active systems within 30 days, subject to legal or backup retention requirements;
• Active subscriptions must be managed separately through the App Store or Play Store, in accordance with platform policies.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws applicable in your country or region of residence, subject to mandatory local consumer protection laws.

Before initiating formal legal proceedings, you agree to attempt to resolve disputes with us in good faith through informal communication.

10. Accessibility and Technical Compliance

Kiwell strives to support accessibility features such as Apple VoiceOver and Google TalkBack. If you encounter accessibility issues, please contact us.

We apply industry-standard technical and organizational measures to protect user data, consistent with our Privacy Policy.
